Liability Waiver, Release, and Assumption of Risk Agreement

1. Acknowledgement of Risk

Participant acknowledges and understands that the use of gym equipment, participation in physical exercise, fitness classes, and related activities at the Facility involves inherent risks, including but not limited to serious bodily injury, illness, permanent disability, heart attack, stroke, and death. Participant voluntarily accepts and assumes all risks, known and unknown, associated with such activities.

2. Release of Liability

In consideration for being permitted to access and use the Facility, Participant hereby releases, waives, discharges, and holds harmless the Released Parties from any and all claims, liabilities, demands, damages, actions, causes of action, costs, and expenses, including attorney’s fees, arising out of or relating to any loss, injury, or damage, whether to person or property, that may be sustained while on the premises or as a result of participating in any activity at the Facility, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by Florida law.

3. Indemnification 

Participant agrees to indemnify and hold harmless the Released Parties from and against any and all claims, actions, damages, liabilities, and expenses (including reasonable attorneys’ fees) resulting from or arising out of Participant’s use of the Facility or participation in any activity thereon.

4. Health Certification 

Participant certifies that they are in good physical condition and have no medical reason or impairment that would prevent them from engaging in physical activity. Participant understands that they should consult a physician before starting any fitness program.

5. Use of Equipment & Facility Rules

Participant agrees to follow all posted rules and instructions provided by Facility staff and acknowledges responsibility for using the Facility and its equipment in a safe and responsible manner.
